What does Stella Point Capital, LP do with your personal information?

Why?

Financial companies choose how they share your personal information. U.S. Federal law gives consumers the right to limit some but not all sharing. Federal law also requires us to tell you how we collect, share, and protect your personal information.

In addition to U.S. Federal laws, certain countries and U.S. states may provide resident individuals with additional rights including a right of “erasure” or “deletion”. These additional laws include: the European Union’s and UK’s General Data Protection Regulations (GDPR), the Data Protection Law, 2017 of the Cayman Islands (DPL), the California Consumer Privacy Act of 2018 (CCPA) and the New York SHIELD Act.

This privacy statement is intended to inform you of your rights with respect to your personal data and to provide you with the information necessary to exercise those rights.

What?

The types of personal information we collect and share depend on the product or service you have with us. This information can include:

  • Social Security number and address/phone number
  • Income/net worth, details of business background and source of wealth
  • Personal ID document and transactions with the Firm and its affiliates

When you are no longer our customer, we continue to share your information as described in this notice, except if you are within a jurisdiction that allows you to exercise a right of “erasure” or “deletion”, such as the EU, UK, the Cayman Islands and the State of California.

How?

All financial companies need to share investors’ personal information to run their everyday business. In the section below, we list the reasons financial companies can share their
Investors’ personal information; the reasons Stella Point Capital chooses to share; and whether you can limit this sharing. Mobile information will not be shared with third parties/affiliates for marketing/promotional purposes. All the below categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

How does Stella Point Capital protect my personal information?

We are committed to protecting your personally identifiable information from unauthorized access and use. To help protect your personal information, we implement and maintain appropriate technical, physical and administrative safeguards. Access to your personal information is restricted to only those employees who need to know that information to provide our services to you. Our employees receive training to maintain the confidentiality, privacy and security of your personal information.

How does Stella Point Capital collect my personal information?

We collect your personal information, for example, when you

  • invest in a fund or make a capital contribution
  • receive a distribution or correspond with the Firm
  • correspond with the fund administrator

As a valued investor, we collect personal information about you at each step of the investment cycle, from initial investment to final distribution.

Why can’t I limit all sharing?

Federal law gives you the right to limit

  • only sharing for affiliates’ everyday business purposes—information about your creditworthiness
  • affiliates from using your information to market to you
  • sharing for nonaffiliates to market to you

Other country and state laws as well as individual companies may give you additional rights to limit sharing.
The Cayman Islands’ DPL, California’s CCPA, and the EU and UK’s GDPR, depending on your residence, may provide you with additional rights, such as:

  • To request access to your data
  • To rectify your data
  • To take your data (portability) to another service provider
  • To erase your personal data
  • To restrict or object to the processing of your personal data
  • To lodge a complaint with a regulatory authority.

All of the above may apply barring competing regulatory requirements, such as those from the SEC, or legal reasons, that would prevent us from executing one of other rights requests.

How long we retain your data

Affiliates

Companies related by common ownership or control. They can be financial and nonfinancial companies.

  • Firm affiliates include the private equity funds that we manage as well as their general partner entities.

Nonaffiliates

Companies not related by common ownership or control. They can be financial and nonfinancial companies.

  • These include the administrator of the private equity funds that we manage, as well as our accounting and audit firms.

Joint marketing

A formal agreement between nonaffiliated financial companies that together market financial products or services to you.

  • The Firm does not share your information with nonaffiliated financial companies for the purpose of marketing to you.

From time to time we may update this privacy statement. If revisions are made to the privacy statement, we will update the statement with a new revision date.
